Landatu Solar undertakes to fulfill its obligation of confidentiality regarding personal data and its duty to treat them with confidentiality, assuming, for this purpose, the technical, organizational, and security measures necessary to prevent their alteration, loss, treatment, or unauthorized access, in accordance with the provisions of Organic Law 15/1999 of December 13, on the Protection of Personal Data, the new European regulation EU – 2016/679, and other applicable legislation.

The data collected are stored under confidentiality and the legally established security measures determined according to our risk analysis and impact assessment, and will not be transferred or shared with companies or entities outside the legal responsible party of the website except in the cases provided for in section ‘6. Third-party service providers

In order to guarantee adequate technical security measures, Landatu Solar contracts trusted external providers to support the technological services on which the Landatu Solar platform relies.

Specifically, Landatu Solar works with the hosting and technological infrastructure provider Siteground, whose servers are located in Europe. Likewise, the CRM technology used by our business team, Hubspot, also acts as the data processor, within its data center located in Europe.

Access to personal data the responsibility of the user/client.

The provision of services performed by Landatu Solar for the Registered User will involve Landatu Solar’s access to personal data files for which the Registered User or client is responsible. These data are captured by Landatu Solar users through the services offered by our company: in this scenario, Landatu Solar acts as a data processor, where it exercises the responsibility of the data processor, while the client/user acts as the ‘data controller’.

Such access will be made exclusively for the purpose of providing the services offered by our company.

Landatu Solar undertakes to implement all necessary security measures for such files, in accordance with the provisions of Royal Decree 1720/2007, of December 21, 2007, on Security Measures for automated files containing personal data. Any security measure above basic level must be communicated in advance by the User to Landatu Solar so that it can take appropriate measures, if necessary.

The DATA PROCESSOR authorizes the subcontracting of the services that Landatu Solar must provide and subcontractors. Specifically, the hosting and system infrastructure services as stated in point 6 of this Privacy Policy.

Landatu Solar will ensure that all its workers who need to access the files of the DATA PROCESSOR are aware of their obligation of professional secrecy and absolute confidentiality and reserve regarding the personal data to which they must access to fulfill the agreed services, all with the appropriate contractual agreements of confidentiality.

In the event that the owners of the personal data contained in the files of the DATA PROCESSOR exercise their rights of access, rectification, cancellation, or opposition before Landatu Solar, the latter must transfer the exercised right or rights to the FILE MANAGER within a maximum period of two days, so that the latter resolves within the deadlines established by current regulations.

When the provision of services contracted between both parties ends, Landatu Solar must return to the DATA PROCESSOR the data that the latter has provided to carry out the contracted services. If the return is not possible, Landatu Solar must proceed to the destruction of all data by secure means that prevent third parties from accessing the destroyed data. However, and without prejudice to the existence of a legal provision requiring its preservation, in which case they must be returned, guaranteeing said preservation by the DATA PROCESSOR.

Change of Ownership

In the event of acquisition, merger, or any other causes that result in a change of ownership of the website and the data controller, the User expressly consents to Landatu Solar transferring their registration data and INFORMATION to the new owner, who may be national or foreign. When this occurs, Landatu Solar will, in any case, comply with the duty to inform the User in this regard.
