Manufacturer’s data
LANDATU SOLAR S.L. (from now on “Landatu” or the “Company“) with registered office at P.I. Leguizamón. C/ Nerbioi 3 (Módulo 1), 48450 Etxebarri, Bizkaia, Spain and holder of Tax Identification Number ESB09960816, develops and issues the following document forming the LIMITED WARRANTY DECLARATION for its Landblock® system, water-ballasted supports for flat surfaces
Product data
Our Landblock® ballasted solar panel structure is made of high-density polyethylene (HDPE), to which several additives (additivation) are incorporated, such as UV stabilizer and antioxidant, to improve its properties and resistance against various external agents.
Our production process is subject to strict quality controls by our Quality Assurance (QA) department, which performs periodic tests and tracking of the manufactured units. Therefore, manufacturing defects are largely mitigated or even excluded from the commercialization of our products.
According to tests, trials, and analyses carried out by Landatu, our supports have an estimated service life of more than 25 years, thanks to the materials used and the product design.
Once the installation of any of our products is completed, the customer must verify the correct assembly by inspecting the connection of the different parts that make up the structure. Within the project’s possibilities and site conditions, the customer must confirm and ensure the proper functioning of the supports as well as of the installed fixing systems.
Scope of the warranty
Landatu establishes that the warranty period for its supports shall begin on the date of invoicing of the material received by the customer (“Warranty Start Date”). Landatu guarantees that the supports are free from material and workmanship defects under normal conditions of application, installation, and service for which they were designed.
Landatu offers a TEN (10) year warranty period from the Warranty Start Date.
Any repair or replacement of our products with additional supports shall not initiate or activate a new warranty period under any circumstances, nor shall it extend the original terms of the present warranty document under any premise.
This warranty covers exclusively manufacturing defects attributable to Landatu. Under no circumstances shall it be understood as a guarantee of the performance of the photovoltaic system in which the supports are installed, nor of compatibility with other structural or electrical components not supplied by Landatu.
Complaints procedure
To make this warranty effective, the customer must submit the name and tax identification number (NIF) of the requesting company, together with the invoice showing the invoice number or reference, date, quantity, and amount paid for the Landblock® supports. Both documents (i.e., the invoice and this document, the “Warranty Certificate”) must be signed and sent within no more than thirty (30) days from the date of invoice issuance to the following email address: info@landatusolar.com, or by certified letter in writing to the Landatu address indicated in the header of this document.
The Customer must attach to the above documentation detailed information about the installation for which the warranty is being requested. This information must include, at a minimum, the following details:
a) Installation Location: the exact address or geographical coordinates of the installation site must be provided.
b) Basic Installation Characteristics: this information must include, but is not limited to: the installation layout plan, site characteristics, ballast weight used (in kg), or any other element employed for securing the installation, as well as photographs of the installation.
The Customer acknowledges and agrees that it is their responsibility to provide the required information in a timely and accurate manner to ensure the proper processing of any warranty request.
Claims related to this warranty must be submitted within the established time frame and in the prescribed manner.
Any claim under this warranty will only be accepted after written notification of the claim has been made within ten (10) days from identification of the issue and subject to submission of this document and proof of purchase. Furthermore, the customer must provide evidence demonstrating the deterioration or damage to the support, such as photos or videos, to the email address indicated above.
Each claim must include all supporting evidence, documents, and/or purchase invoices verifying the delivery and installation dates. The purchase invoice must be an official invoice issued by our company or an authorized distributor, clearly stating the end customer’s data, purchase date, quantities, and prices for the Landblock® supports. It must always bear the stamp or signature of Landatu or any of its authorized distributors.
Under no circumstances will Landatu accept the direct return of any of its products without prior authorization resulting from a properly managed claim in accordance with the procedure outlined herein.
Any claim filed against Landatu under the warranty established in this document shall only be considered valid and enforceable if the buyer is able to provide timely and sufficient evidence that the defective condition of the Landblock® supports results exclusively from defects in materials and/or workmanship during the manufacturing process.
If sufficient evidence is provided to demonstrate that the supports have not complied with the warranty described in this document, Landatu, at its discretion, shall repair or replace only the defective supports, or may, at its sole discretion, opt for a refund of the purchase price, if Landatu determines so based on the circumstances.
Any replacement products shall remain the property and responsibility of Landatu, and the company may, at any time and at its own discretion, determine the delivery process, applying reasonable criteria for logistics, delivery methods, and time frames, as well as the type of final product supplied, which may differ in shape, color, size, or model from the original product due to product discontinuation, upgrades, or design revisions.
Landatu may require a physical inspection of the supports at the installation site prior to issuing a resolution. In the event that the customer refuses to allow such inspection, the claim shall be automatically rejected.
This warranty does not cover the costs of disassembly, reinstallation, transportation, or handling of the replaced products, all of which shall be entirely borne by the customer.
General exclusions and limitations of the warranty
Landatu shall in no case be responsible for any expenses incurred by the customer in the process of collecting evidence or proof of malfunction of the supports, nor for expenses arising from the transport of damaged supports to our facilities or for the replacement of such supports within the installation.
This warranty shall be invalid and void and shall not cover any failure or defect in the supports arising from incorrect installation, improper maintenance, or any special or unknown conditions of use beyond Landatu’s control, including, but not limited to, damage caused by storms, loads exceeding those specified in our technical manuals due to external agents such as snow, sand, adverse chemical or biological effects, wind gusts beyond the design load, impacts, damage, or obstructions caused by external agents, objects, or bodies.
The installation and maintenance of our support systems must always be performed by qualified personnel, following and completing all steps as established in the manuals and instructions provided by Landatu, which define the intended use and objectives for which they were designed and manufactured, including the load and stress levels they can withstand according to the installation design.
Handling of the supports is restricted to qualified technical personnel who must be familiar with and follow the procedures established in the Landblock® installation and maintenance manuals.
The Customer acknowledges and agrees that, as part of the terms of this warranty, it is their responsibility to perform annual maintenance of the installation covered by this warranty. The Customer must follow the maintenance recommendations detailed in the installation manual provided by the Warrantor.
The Customer undertakes to send the maintenance logbook of the installation to the Warrantor for any claim related to this warranty. The maintenance logbook must be duly completed and reflect the dates and details of the inspections carried out.
Compliance with this annual maintenance requirement is a mandatory condition for the validity of this warranty. The Warrantor reserves the right to deny warranty services if the Customer fails to comply with this requirement.
The Customer is solely responsible for scheduling and carrying out the annual maintenance of the installation. Any damage or malfunction of the product resulting from lack of proper maintenance shall not be covered by this warranty.
Landatu shall under no circumstances be liable for any damage or injury to persons or property, or for any event, situation, loss, or injury arising from any cause beyond or related to the use of our supports, including, without limitation, any defect in the supports, their use, or during their installation.
Under no circumstances shall Landatu be liable for incidental, consequential, or special damages, regardless of the cause. Loss of income, use, profit, or production is expressly excluded without limitation. In any case, the aggregate liability of Landatu, if any, whether in damages or otherwise, shall not exceed the total value of the defective Landblock® supports as reflected in the invoice submitted by the customer to Landatu or an authorized Landblock® distributor, limited exclusively to the supports sold for the specific installation.
Force Majeure
Landatu’s liability shall be null and void toward the Customer or any third party for any delay in fulfilling this warranty document or the sales process caused by external elements or agents such as fires, floods, blizzards, hurricanes, pandemics, earthquakes, terrorism, wars, riots, strikes, shortage of workers or raw materials, or any other event beyond Landatu’s direct control. In such cases, Landatu shall be exempt from all liability, including the obligation to repair or replace the products affected by these events.
Severability
If any provision of this warranty is deemed invalid, null, or unenforceable, the remaining provisions shall continue to be valid and enforceable. Likewise, under any applicable national or international legislation that may affect or interfere with any of the above clauses, the remaining clauses, terms, and conditions of this warranty document shall prevail and remain in force.
Prevalence of the Warranty
This warranty and this document shall supersede and/or exclude any other warranty document, including express or implied warranties such as warranties of merchantability or fitness for a particular purpose, or any other liability attributable to Landatu, unless such obligations and responsibilities are agreed to in writing and signed by Landatu.
Non-Assignment Clause
The Customer, as beneficiary of this warranty, undertakes not to assign, transfer, or delegate their rights under this warranty to any other party without the prior written consent of Landatu. Any attempt to assign without written authorization from Landatu shall be null and void.
Governing Law and Jurisdiction
This document shall be governed by Spanish law. Any dispute arising out of or in connection with this contract shall be exclusively submitted to the courts of Bilbao (Spain), and the parties expressly waive any objection based on lack of jurisdiction, improper venue, or any similar reason.
03. Exclusions and limitations
This warranty, as developed in this document, includes certain limitations and exclusions and shall not apply to sales that fall under one or more of the following circumstances:
- Total or partial non-payment of the purchase price agreed between the parties and stated on the final and official invoice issued by Landatu or any accredited distributor.
- Delays in payment exceeding fifteen (15) days from the terms agreed between the parties.
- When, after analysis, the installation and/or assembly of the entire solar structure — including supports, ballast, and connecting pieces — does not comply with the Landblock® installation manual provided by Landatu.
- Lack of quality control or inspection execution during the various project phases, according to the inspection points defined in our project documentation and/or installation manuals.
- When, after inspections performed by Landatu personnel following project completion, whether on-site or based on documentation provided by the customer, it is determined that the installation fails to meet the quality criteria and requirements defined by our project specifications and inspection points. In such cases, to activate this warranty, the customer shall be responsible for correcting the identified defects in the installation and requesting a new inspection by Landatu to confirm and reactivate the warranty process.
- Mandatory Maintenance Condition: the validity and continuity of the warranty, both standard and extended, are subject to the following requirements:
a) The installation must undergo periodic maintenance at least once every twelve (12) months.
b) Such maintenance must be carried out by qualified technical personnel, trained and authorized by Landatu.
c) All maintenance activities must be recorded in the official Maintenance Logbook of the installation, duly signed by the responsible technician and kept by the Client.
